High Court three-judge panel has lifted injunctions preventing former Nairobi Governor Mike Mbuvi Sonko from being cleared by the Independent Electoral and Boundaries Commission (IEBC).
The bench, led by Justice David Majanja, concluded that the issue of eligibility lies at the heart of the combined petitions and that the parties should be given a chance to be heard before any decisions are made.
“The orders denied the IEBC the constitutional mandate to discharge its duty which includes deciding whether to accept or decline at the nomination stage. The process is governed by clear constitutional statutory provisions,” ruling partly read.
