Former Nairobi County Governor Mike Sonko

A petition has been filed in court seeking to have former Nairobi Governor Mike Sonko barred from vying for the Mombasa Governor seat in the upcoming August General Election.

Mike Sonko is disqualified from holding public office, according to the petitioners, Ndoro Kayuga and George Odhiambo.

“The 1st Respondent is disqualified from contesting for and being elected into the position of Governor of Mombasa County and from holding any other State office by virtue of Article 75 (3) of the Constitution,” the petition state.

They further contend that Wiper’s nomination of Sonko was illegal. The petition continues, “The 1″ Respondent and the 1st Respondent’s choice to accept the nomination while being disqualified by the Constitution is a violation of the Petitioners’ fundamental rights to free, fair, and regular elections, as provided by Article 38 (2) of the Constitution.”

The petitioners seek the court to grant an injunction preventing the IEBC from approving Sonko’s candidacy in the next elections.

They say that if Sonko is not allowed to compete, he will not be prejudiced.
The Nairobi County Assembly impeached Sonko in December 2020 on charges of severe misconduct and misuse of power.

Sonko received a straight nomination ticket for the seat in the August elections from the Wiper party last week.
